Tides of Qi — Terms of Use

These terms govern your use of Tides of Qi ("the App"), operated by Vid Skvarca, Ljubljana, Slovenia, EU. By using the App, you agree to these terms. If you do not agree, do not use the App.

The service

Tides of Qi is a personal astrology app that generates daily readings based on your birth data. Readings are a combination of classical calculations and AI-generated narrative text.

The App provides entertainment and self-reflection content only. It is not and does not replace:

The readings are personal reflection tools for entertainment and self-reflection only. They do not predict the future. Do not use them to make medical, financial, or other important life decisions.

Accounts

You sign in using Apple Sign In. You may use the App in a limited free mode without signing in. Full features require an active subscription.

You may delete your account at any time from the Account screen. Deletion is permanent. See our Privacy Policy for details.

Subscriptions

Tides of Qi offers auto-renewable subscriptions managed by Apple. Current pricing is displayed on the subscription screen in the App and in the App Store, and may vary by region.

Auto-renewal: Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the current period ends.

Free trial: If offered, the free trial is limited to one per person and Apple ID. The trial begins when you subscribe. If you cancel during the trial, you will not be charged. If you do not cancel, your account will be charged at the end of the trial period.

Managing subscriptions: You can manage or cancel your subscription in iOS Settings. Go to Settings, tap your name, tap Subscriptions, then tap Tides of Qi.

All payments are processed by Apple. We never see or store your payment information.

EU/EEA users: By subscribing and beginning to use the service, you expressly consent to immediate access to the digital content and acknowledge that you lose your right of withdrawal under the EU Consumer Rights Directive once the service has begun.

AI-generated content

Some readings include AI-generated text produced by a third-party service. AI-generated content may occasionally contain inaccuracies or inconsistencies. We apply quality measures but do not guarantee that every reading is accurate. All content is provided for personal reflection purposes only.

Content and intellectual property

All readings, illustrations, animations, and written content in the App are owned by Tides of Qi or used under license. You may not reproduce, distribute, or create derivative works from the App's content without written permission.

You may share your own readings (e.g., screenshots) for personal, non-commercial purposes.

You agree not to:

Fair use and suspension

The App includes AI-generated content that incurs costs for each generation. We reserve the right to limit, suspend, or terminate access to the App or any of its features if we reasonably determine that your usage is excessive, abusive, or intended to circumvent subscription requirements — including but not limited to repeatedly creating and deleting accounts to access content without a subscription.

We may exercise this right at our sole discretion, with or without prior notice. Where practical, we will attempt to notify you before taking action.

Indemnification

You agree to indemnify, defend, and hold harmless Vid Skvarca and any affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from or related to your use or misuse of the App, your violation of these terms, or your violation of any third-party rights.

Limitation of liability

To the maximum extent permitted by applicable law, Vid Skvarca and Tides of Qi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to decisions made based on the App's readings.

In no event shall our total liability to you exceed the amounts you have actually paid to us through the App in the twelve (12) months preceding the claim.

The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Force majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, internet or infrastructure outages, third-party service failures, government actions, or pandemic-related disruptions.

Claims deadline

Any claim or cause of action arising from or related to your use of the App must be filed within one (1) year after the claim arose, or it is permanently barred.

Business transfers

If Tides of Qi is involved in a merger, acquisition, or sale of assets, your personal data may be transferred as part of that transaction.

Informal dispute resolution

Before initiating any formal legal proceeding related to these terms, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Governing law

These terms are governed by the laws of the Republic of Slovenia. Any disputes that cannot be resolved informally shall be submitted to the competent courts of Ljubljana, Slovenia. This does not affect your rights under mandatory consumer protection laws of your country of residence.

Severability

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

Entire agreement

These terms, together with the Privacy Policy, constitute the entire agreement between you and Vid Skvarca regarding your use of Tides of Qi. They supersede any prior agreements or understandings.

Changes to these terms

We may update these terms from time to time. The "last updated" date will change. Continued use of the App after changes constitutes acceptance of the updated terms.
